site licenses and AI Services
Eccentex’s Fair Use Policy promotes responsible, lawful, and secure use of its cloud services, helping protect platform performance, customer data, and a reliable experience for every user.
ECCENTEX FAIR USE POLICY

Purpose and scope
This Fair Use Policy (“Policy”) governs use of Eccentex Site License and other subscription offerings that provide unlimited or substantially unlimited user access to the Eccentex HyperAutomation Cloud platform (“Platform”).
A Site License is intended to enable broad adoption of the Platform within the Customer organization identified in the applicable Order Form for a fixed subscription fee, without imposing a technical limit on the number of Authorized Users, unless otherwise specified in the applicable agreement.
The purpose of this Policy is to protect the security, availability, performance, integrity, and economic sustainability of the Platform while allowing Customers to scale legitimate business use without unnecessary restrictions.
This Policy forms part of the agreement governing the Customer’s use of the Platform (“Agreement”). If this Policy conflicts with an expressly negotiated term of an Order Form or Agreement, the negotiated term will control to the extent of the conflict.
Meaning of “Unlimited”
Unless expressly stated otherwise in an Order Form, an “unlimited users,” “Site License,” or similar entitlement means that the Customer may authorize an unlimited number of eligible users within the licensed Customer organization or Site to access the applicable Platform functionality.
An unlimited user entitlement does not mean unlimited or unrestricted consumption of infrastructure or usage-based resources, including compute capacity, data storage, network bandwidth, API transactions, artificial intelligence processing, third-party services, communications services, or other metered or transaction-based resources.
Usage-based, transactional, third-party, or separately licensed services are included only where expressly stated in the applicable Order Form.
Principle of fair use
The Platform is intended for legitimate business automation, case management, workflow orchestration, customer engagement, process management, and other business purposes supported by the Platform.
Usage will generally be considered fair when it:
- supports genuine Customer business operations or workflows;
- is consistent with the intended functionality of the Platform;
- does not intentionally or unnecessarily consume disproportionate Platform resources;
- does not materially impair or threaten the availability, security, or performance of the Platform for the Customer or other customers;
- does not circumvent technical, contractual, licensing, or usage controls; and
- remains within any specific usage entitlements, quotas, or metered services identified in the applicable Order Form or documentation.
Legitimate increases in usage resulting from business growth, increased adoption, additional workflows, or increased transaction volumes will not, by themselves, constitute unfair use.
License boundary and third-party use
A Site License is provided for the Customer organization, affiliates, locations, users, or other entities expressly permitted under the applicable Order Form or Agreement.
Unless expressly authorized by Eccentex, a Customer may not use a Site License to:
- resell, sublicense, or commercially redistribute access to the Platform;
- operate the Platform as a service bureau or shared platform primarily for unrelated third parties;
- extend unlimited user entitlements to organizations or entities outside the licensed scope; or
- use the Site License primarily to avoid licensing requirements that would otherwise apply to another organization.
Use by contractors, service providers, affiliates, customers, or other third parties is permitted where authorized by the applicable Agreement and consistent with the Customer’s legitimate business operations.
Prohibited and unfair usage
Unfair, abusive, or prohibited usage includes, without limitation:
- intentionally generating artificial workloads, transactions, API calls, or other activity for the purpose of consuming resources or testing capacity without a legitimate business purpose;
- creating runaway, recursive, or unnecessarily repetitive automated processes that generate excessive resource consumption;
- intentionally circumventing usage controls, rate limits, licensing restrictions, security mechanisms, or other safeguards;
- using Platform infrastructure primarily for computational workloads unrelated to supported Platform business functions;
- using the Platform as a general-purpose data warehouse, file archive, backup repository, content distribution service, or storage service unrelated to legitimate Platform workflows;
- generating excessive or unnecessary API traffic, including avoidable polling or repeated requests where more efficient supported integration methods are reasonably available;
- conducting vulnerability scanning, penetration testing, load testing, stress testing, denial-of-service testing, or similar security or performance testing without prior authorization from Eccentex;
- using Platform resources to attack, disrupt, probe, or interfere with Eccentex systems or any third-party system;
- intentionally creating activity that materially degrades or threatens Platform stability, security, availability, or performance; or
- using the Platform in a manner otherwise prohibited by the Agreement, applicable documentation, or applicable law.
Eccentex will consider the nature, duration, frequency, business purpose, technical impact, and resource consumption of an activity when determining whether usage is unfair. No single usage metric will necessarily determine whether a violation has occurred.
Artificial Intelligence services
AI functionality made available through the Platform is intended to support legitimate business automation, augmentation, analysis, assistance, and workflow processing.
Unless expressly included in the applicable Order Form, the Site License does not include unlimited usage of AI models, tokens, inference services, AI credits, third-party AI services, or other transaction-based AI resources.
AI services may therefore be subject to separate usage entitlements, transaction charges, rate limits, credits, provider restrictions, or other commercial terms.
A Site License may not be used primarily to perform unrelated high-volume AI computation, mass synthetic content generation, general-purpose model training, model experimentation, or other AI workloads that are not reasonably connected to Customer business processes implemented through the Platform.
Nothing in this section prevents normal use of AI capabilities within legitimate Customer workflows.
Data storage
Customers may store and process data reasonably required for Platform workflows and supported business purposes, subject to the Agreement and applicable storage entitlements.
The Platform may not be used primarily as a general-purpose file storage, archival, backup, media hosting, or data warehousing service unless such use is expressly supported by the applicable subscription.
Eccentex may review storage consumption patterns and work with the Customer where storage usage is materially inconsistent with the intended use of the Platform.
Integrations and API usage
Customers may use supported APIs and integrations for legitimate business integration, automation, orchestration, migration, import, export, and other documented Platform functions.
Customers are responsible for designing and operating integrations in a commercially reasonable manner.
Integration patterns that produce unnecessary requests, excessive polling, uncontrolled retries, abnormal request volumes, duplicate transactions, or other avoidable system load may be considered unfair usage.
APIs may not be used primarily as an unauthorized bulk extraction, replication, or data distribution mechanism. This restriction does not prohibit supported export, backup, migration, reporting, or integration functionality made available or authorized by Eccentex.
Eccentex may apply reasonable technical rate limits or safeguards where necessary to protect Platform security, stability, or performance.
Monitoring and operational safeguards
Eccentex may monitor Platform usage and operational telemetry to identify security threats, service degradation, abnormal resource consumption, potential violations of this Policy, and capacity requirements.
Such monitoring may include resource consumption, transaction volumes, API request rates, storage utilization, processing activity, error rates, and similar operational information.
Nothing in this Policy grants Eccentex additional rights to Customer Data beyond those provided in the Agreement, applicable privacy terms, or data processing agreement.
Where necessary to protect the Platform, Eccentex may implement reasonable safeguards such as rate limiting, throttling, temporary workload restrictions, isolation of problematic processes, or other activity-specific controls.
Excessive usage and remediation
Where Eccentex reasonably determines that Customer usage materially violates this Policy or creates a disproportionate operational, security, technical, or financial impact, Eccentex will generally notify the Customer and provide sufficient information to allow the Customer to investigate and remediate the issue.
Where reasonably practicable, Eccentex will provide the Customer an opportunity to correct the usage pattern before imposing material service restrictions.
Remediation may include optimization of workflows or integrations, correction of runaway processes, implementation of reasonable technical controls, reduction of unnecessary resource consumption, or migration to capacity or commercial terms appropriate for the Customer’s sustained usage requirements.
If excessive or unfair usage continues after reasonable notice and an opportunity to remediate, Eccentex may impose appropriate technical controls, require a commercial review, require additional capacity or separately metered services, or suspend the affected functionality in accordance with the Agreement.
Additional fees will apply only where authorized by the Agreement, applicable Order Form, or another agreement between Eccentex and the Customer.
Emergency action
Notwithstanding the normal remediation process above, Eccentex may take immediate action where Eccentex reasonably determines that Customer activity:
- creates an immediate or material security risk;
- threatens the availability or integrity of the Platform;
- materially affects other customers or Eccentex infrastructure;
- involves suspected unlawful activity; or
- requires immediate action to comply with applicable law or a binding governmental requirement.
Where circumstances permit, Eccentex will notify the Customer of such action and will work with the Customer to restore normal service after the relevant risk has been addressed.
Customer Responsibilities
Customers are responsible for ensuring that their Authorized Users, applications, automated processes, integrations, agents, bots, and other systems accessing the Platform comply with this Policy.
Customers agree to reasonably cooperate with Eccentex in investigating and resolving usage patterns that materially affect Platform reliability, security, performance, or availability.
Legitimate business scaling
This Policy is not intended to discourage or restrict legitimate adoption of the Platform.
Increasing numbers of users, business processes, cases, workflows, transactions, integrations, or automation volumes resulting from genuine Customer business requirements are expected uses of the Platform.
Eccentex will not treat increased business usage as a violation merely because the Customer obtains greater value from its Site License.
This Policy is intended to address abuse, unintended or inefficient resource consumption, usage outside the licensed scope, and workloads that create disproportionate impact—not successful adoption of the Platform.
Changes to this policy
Eccentex may update this Policy from time to time to address changes in technology, security requirements, Platform functionality, third-party service requirements, operational conditions, or applicable law.
Eccentex will provide reasonable notice of material changes where practicable.
Except where a change is reasonably required to address an urgent security issue, legal requirement, abuse pattern, or third-party service requirement, material changes to this Policy will not be applied in a manner intended to substantially reduce expressly committed contractual entitlements during an existing subscription term.

Questions regarding this Policy or anticipated usage patterns may be directed to the Customer’s Eccentex account representative or Eccentex Sales.
Customers planning unusually large deployments, high-volume integrations, intensive AI workloads, or other significant Platform usage are encouraged to consult Eccentex in advance so that appropriate architecture, capacity, and commercial arrangements can be established.
